NAPA VALLEY STREAMFEST

VOLUNTEER AGREEMENT AND RELEASE OF LIABILITY

READ BEFORE SIGNING

1. VOLUNTARY PARTICIPATION: I signee, acknowledge that I have voluntarily
applied to participate in NAPA VALLEY STREAMFEST located in Napa CA. I
understand that my participation in Napa Valley StreamFest involves inherent risks of
personal injury, property damage, and even death.
2. ASSUMPTION OF RISK: I AM AWARE THAT MY PARTICIPATION IN NAPA
VALLEY STREAMFEST MAY INCLUDE HAZARDOUS ACTIVITIES. I AM
VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF
THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT ANY AND ALL
RISKS OF INJURY OR DEATH, AND VERIFY THIS STATEMENT BY SIGNING.
3. RELEASE: As consideration for being permitted by Napa Valley StreamFest to
volunteer for these activities and use the related facilities, I hereby agree that I, my assignees,
heirs, distributes, guardians, and legal representatives will not make a claim against, sue, or
attach the property of Napa Valley StreamFest on account of injury or damage resulting from
the negligence or other acts, howsoever caused, by any employee, agent, participant, or
contractor of Napa Valley StreamFest as a result of my participation in Napa Valley
StreamFest. I hereby release Napa Valley StreamFest from all actions, claims, or demands
that I, my assignees, heirs, distributers, guardians, and legal representatives now have or may
hereafter have for injury or damage resulting from my participation in Napa Valley
StreamFest.
4. INDEMNIFICATION: I agree to defend and indemnify Napa Valley StreamFest, its
employees, agents, officers and directors and hold it harmless for any claim for liabilities,
costs, expenses (including reasonable attorneys’ fees actually incurred) damages or injuries
arising out of or resulting from my participation in Napa Valley StreamFest including, but not
limited to, personal injury, death, or property damage, even if Napa Valley StreamFest, its
employees, agents, officers, directors or program director are also negligent or otherwise at
fault. Such obligation to indemnify and hold harmless Napa Valley StreamFest, its
employees, agents, officers, directors and program director shall survive the time of my
participation in the Napa Valley StreamFest.
5. NON DISCLOSURE/CONFIDENTIALITY: I will not, except as authorized or
required by my duties hereunder, reveal or divulge to any person or entity any information
concerning the organization, business, finances, transactions, or other affairs of Napa Valley
StreamFest or its affiliates, which may come to my knowledge during the continuance of this

Agreement. Any confidential information received during furtherance of this Agreement will
be treated in full confidence and will not be revealed to any other persons, firms or
organizations unless, pursuant to a legal duty to do so.
6. PHOTOGRAPHY: I hereby give consent to have any and all photographs and any other
audio/visual materials taken of me for promotional material, educational activities,
exhibitions or for any other use for the benefit of Napa Valley StreamFest and such materials
will be the property of Napa Valley StreamFest.
7. SEVERABILITY: I further understand that this agreement is intended to be as broad
and inclusive as is permitted by law. If any provision or any part of any provision of this
Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this
Agreement shall not be affected thereby and shall remain valid and fully enforceable.
8. CONSTRUCTION: This Agreement is entered into and its construction and
performance are governed by the laws of the State of California. The parties agree that the
forum for any action arising out of or relating to this Agreement shall be state court in Napa
CA and hereby consent to the jurisdiction of that court and venue. This Agreement shall be
deemed to have been drafted by all parties and no rules of construction shall be applied
against any party as the drafter.
9. KNOWING AND VOLUNTARY EXECUTION: I CERTIFY THAT I AM OF
LAWFUL AGE (18 YEARS OR OLDER) AND OTHERWISE LEGALLY COMPETENT
TO SIGN THIS AGREEMENT. I FURTHER UNDERSTAND THAT THE TERMS OF
THIS AGREEMENT ARE LEGALLY BINDING AND I CERTIFY THAT I AM SIGNING
THIS AGREEMENT, AFTER HAVING CAREFULLY READ IT, OF MY OWN FREE
WILL. BY SIGNING THIS AGREEMENT:
a. I assume all risk of injury, wrongful death, or property damage I might suffer
while participating in Napa Valley StreamFest, even if it comes as a result of the
negligence or other fault of Napa Valley StreamFest, its employees, agents, officers,
directors and program director,
b. I absolve and release Napa Valley StreamFest and its employees, agents,
officers, directors and program director from the consequences of their negligence
and or other fault, and
c. I will indemnify and defend Napa Valley StreamFest and its employees,
agents, officers, directors and program director against any legal actions or other
claims for damages arising as a result of my conduct. I understand that I am
forfeiting important legal rights and incurring important legal responsibilities.

d. In the event I use my personal vehicle for festival related activities, I certify that
I have valid automobile insurance coverage.
